Agreement Terms
1. Agreement
This Agreement is made between Westland Creative LLC, a Wyoming limited liability company, operating in Jackson Hole, Wyoming (“Westland Creative”), and the Client whose details are set forth in the Statement of Work, Proposal, or invoice.
2. Services Provided
Westland Creative will provide the services, deliverables, and hours as described in the Statement of Work, Proposal, or invoice, all of which are incorporated herein by reference (the “Services”). Westland Creative is committed to delivering these Services in a professional and timely manner.
3. Payment Terms
(a) Initial Payment: An initial payment of fifty percent (50%) of the total fee is due upon acceptance of the Proposal or invoice before commencement of the Services. This initial payment is necessary to schedule and initiate the project.
(b) Final Payment: The remaining fifty percent (50%) is due within fifteen (15) days of the delivery of the Service. The delivery of the Service shall be deemed complete when the final deliverable is provided to the Client, or the date specified in the Statement of Work, Proposal, or invoice is reached, whichever occurs first.
(c) Late Payment: Late payments will incur an interest charge at a rate of 1.5% per month or the maximum rate allowed by law, whichever is lower.
4. Scope of Work and Revisions
(a) Westland Creative will perform the Services as described in the Statement of Work, Proposal, or invoice. The Client agrees that payment of the initial fifty percent (50%) deposit confirms their understanding and acceptance of the scope of work as detailed.
(b) Additional Services: Work that goes beyond the agreed scope will incur additional charges at a standard rate of $125 per hour. Payment of the deposit implies the Client's agreement to this rate for any such additional work required.
(c) Revisions: Included in the initial agreement are two (2) rounds of revisions. Subsequent revisions beyond the initial two will be charged at the aforementioned hourly rate of $125. By making the initial payment, the Client agrees to this term.
5. Acceptance of Terms
By paying the initial deposit, the Client agrees to the terms and conditions of this Agreement, including but not limited to the payment schedule, the scope of work, the rate for additional services, and the terms regarding revisions.
